I would obviously discuss this in more detail if you consulted me but there are a couple of things you should be aware of before you even start.
Co-operating
If your problem leads to Court or Tribunal proceedings the Court/Tribunal will take an active role in managing it with the aim of handling it speedily, fairly and at a cost proportionate to the sums of money involved and the complexity of issues. There is a duty on all litigants to assist the court/tribunal with this aim which includes confirming that all information is truthful and disclosing all documents which are supportive to your case or, alternatively, favourable to your opponent.
If you should fail to co-operate, you face the risk of penalties; your Claim/Defence could be struck out or, in some cases, you could be ordered to pay your opponent’s legal costs - payable within as short a period as 14 days. It is therefore important that you provide full details of your claim and reply promptly to all correspondence and requests that are made.
If a party is found to have provided false information they may face a charge of contempt of court.
Reducing your Loss
If you are an employee and your case involves having lost or being about to lose your job the likelihood is that, if your employer is at fault, you will have a claim for loss of earnings beyond the end of the notice period. You have an obligation to try to reduce that loss by finding alternative paid employment. This does not mean that you must take the first opportunity that comes along but you must be active and be seen to be active in looking for work: otherwise any compensation that might be awarded to you could be reduced.
It is very important that you keep copies of all job advertisements that you have considered and notes of all visits to any employment agencies etc. All correspondence about jobs should be retained. In short, keep everything so that you will be able to show that you have been looking and keep notes about why any particular job is not suitable to you.
